Meeting Healthy Homes Obligations for Landlords

For many landlords, the "Healthy Homes" deadline was a date circled in red on the calendar—a finish line to cross. But in reality, meeting that initial deadline was only the first step.

In the current New Zealand rental landscape, compliance isn't a one-time milestone; it’s a continuous responsibility. Why "Ongoing" is the New Standard

The Healthy Homes Standards cover five key areas: heating, insulation, ventilation, moisture ingress/drainage, and draught stopping. The "ongoing" part of the law means that if a system fails, your compliance fails with it.

If a heat pump stops working or insulation is moved by a tradie during a wiring fix, the property is technically no longer compliant even if it passed an assessment a year ago.

  • Ventilation: Are extractor fans actually functioning, or are they just making noise?
  • Insulation: Has it remained intact and at the required thickness throughout the ceiling and underfloor?
  • Moisture & Drainage: Are gutters clear and is the ground moisture barrier still performing its job?

In any Tenancy Tribunal matter, documentation is your shield. Compliance isn't just about the physical work; it’s about the record-keeping that proves it. To protect your investment from financial penalties, you need a "living" file containing:

  1. Current Healthy Homes Compliance Statements.
  2. Invoices for all upgrades and professional installations.
  3. A clear history of maintenance (e.g., when the heat pump filters were last cleaned).

Smoke Alarms: The 24/7 Safety Check

While insulation gets the headlines, smoke alarms remain a critical, high-risk area for compliance. Landlords must ensure alarms are working at the start of every tenancy and remain in working order throughout.

Any replacement alarms must now be photoelectric with a battery life of at least eight years. While tenants have a role in letting you know if a battery dies, the legal burden to ensure a working alarm exists sits squarely with the landlord.
